These Terms of Use ("Terms") govern your use of this website (the "Site") operated by Eighteen1 Studios ("we", "us", "our") for Byde. By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. Nature of the Site
The Site is a marketing and information website. It describes the Byde app, hosts legal information such as our Privacy Policy and Imprint where applicable, and offers limited features such as a contact form and press materials. The Site is not the Byde application itself.
2. The Byde app and Apple's End User License Agreement
The Byde mobile application is distributed through the Apple App Store. Your download and use of the app are governed by Apple's Licensed Application End User License Agreement (the "Apple Standard EULA") between you and Apple, together with the App Store terms that apply in your region.

Any in-app purchases or subscriptions are offered and billed by Apple under Apple's rules. These Terms do not govern the app; the Apple Standard EULA and Apple's terms do, in addition to any separate terms we may present inside the app where required.
3. No accounts or purchases on this Site
You cannot create a user account on this Site, and we do not sell goods or services or take payment through this Site. If we add sign-in, checkout, or similar functionality later, we will update these Terms.
4. Contact
The Site may include a contact section where you can send us a message. You agree that you will not use it to transmit unlawful, harassing, defamatory, obscene, or threatening content, spam, malware, or misleading information, or to impersonate another person or entity. You are responsible for the content you send.
We may use the information you provide to respond to you and to operate and support Byde, as described in our Privacy Policy. We are not obligated to respond to every message.
5. Press kit
The Site may include a press area where you can download a press kit or similar materials. Those materials are provided for informational and editorial use unless we state otherwise on the page. You must not misrepresent your relationship with Byde or Eighteen1 Studios, and you must follow any usage notes we publish alongside the files.
6. Acceptable use
You agree not to misuse the Site. For example, you must not attempt to gain unauthorized access to our systems, interfere with the Site's operation, scrape the Site in a way that burdens our infrastructure, or use the Site in violation of applicable law.
7. Intellectual property
The Site and its content (including text, graphics, logos, and layout) are owned by Eighteen1 Studios or our licensors and are protected by applicable intellectual property laws. Unless we give you prior written permission, you may not copy, modify, distribute, sell, or create derivative works from the Site or its content, except where mandatory law allows.
8. Third-party links
The Site may link to third-party websites or services (for example, the App Store). We do not control those sites. Your use of third-party services is at your own risk and subject to their terms and privacy policies.
9. Information on the Site
Materials on the Site are provided for general information. We may update the Site at any time but are not obliged to keep every detail current. You should not rely solely on the Site for decisions that require professional advice.
10. Disclaimer of warranties
To the fullest extent permitted by law, the Site is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of liability
To the fullest extent permitted by law, Eighteen1 Studios and its directors, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunities, arising out of or in connection with your use of the Site or inability to use the Site, even if we have been advised of the possibility of such damages.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted by applicable law.
12. Indemnity
You agree to indemnify and hold harmless Eighteen1 Studios and its directors, employees, and contractors from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your violation of these Terms or your misuse of the Site, to the extent permitted by law.
13. Privacy
Our processing of personal data related to the Site is explained in our Privacy Policy.
14. Changes
We may update these Terms by posting a new version on this page. Continued use of the Site after changes take effect means you accept the updated Terms.
15. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in effect.
16. Governing law
These Terms are governed by the laws of Germany, without regard to conflict-of-law principles, subject to mandatory consumer protections that may apply to you in your country of residence and cannot be waived by contract.
